Motorcyclist awarded £253,000 in crash compensation

LIMASSOL District Court has awarded a 36-year-old motorcyclist £253,000 in compensation following a crash that left his leg severely injured.

Panayiotis Agapiou, who has been walking with a limp since, was riding his motorcycle on the Limassol-Paphos highway in August 1998 when the defendant drove his car into the then 29-year-old’s rear.

The collision resulted in Agapiou and his bike skidding a long distance across the road before landing in a ditch.

Suffering from shock, the defendant had lost his senses, leaving Agapiou with his badly damaged leg to crawl out of the ditch and seek assistance.

The two were taken to hospital where the defendant was given first aid and allowed home. Agapiou remained in hospital and was given lengthy treatment.

The driver admitted to careless driving in court, saying that he hadn’t noticed the motorcyclist.

The Court rejected the defendant’s suggestion that the responsibility was joint.

Taking into consideration the extent of Agapiou’s injuries and his extensive treatment along with the pain and hardship he had suffered, the Court decided to award him with £100,000 for general damages, £57, 861 for specific damages and £40,000 for the loss of future income.
