Supreme Court to decide next week on Tymbou case

THE Supreme Court yesterday reserved judgement on an appeal filed by the Attorney-general over a district court decision not to sentence a Nicosia man who flew to Istanbul through the airport of Tymbou in the occupied areas.

The man pleaded guilty to two charges of exiting and entering the Republic through an illegal point of entry.

However, the court decided not to sentence the 56-year-old, as a conviction would have violated constitutional provisions concerning equal treatment.

Attorney-general Solon Nikitas filed the appeal on Wednesday, arguing that the decision was wrong.

He requested the annulment of the decision and maintained that the court was obliged to impose a sentence since the man was found guilty.

Nikitas asked the Supreme Court to order the district court to impose a sentence.

The Supreme Court heard the state’s case yesterday, but reserved its judgement for next week.
